These Terms of Service ("Terms") govern your access to and use of the Kamuzigo platform, including our website and mobile applications (collectively, the "Services"). By using our Services, you agree to be bound by these Terms.

1. The Kamuzigo Service

Kamuzigo is a neutral digital marketplace that connects individuals and businesses seeking to transport goods ("Shippers") with independent drivers ("Drivers"). We are not a carrier or a transport company. Our service is to provide the platform that facilitates these connections.

2. User Accounts

You must register for an account to access most features of the Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your account, whether or not you have authorized such activities or actions.

3. Roles and Responsibilities

For Shippers:

You agree to provide accurate and complete details about the goods you wish to transport.
You are responsible for preparing and packing your goods for transport.
You agree to pay the agreed-upon fees for the transport services, including the Kamuzigo Protection Fee (KPF).
You are responsible for confirming the delivery of your goods in a timely manner to release the payment from escrow.

For Drivers:

You warrant that you have the necessary licenses, permits, and insurance to operate as a driver in Kenya.
You agree to perform the transport services in a professional and timely manner.
You are responsible for the safety and security of the goods while they are in your possession.
You agree that Kamuzigo may collect a fee from the Shipper for the use of the platform. Kamuzigo does not charge drivers a commission.

4. Payments and Fees

Shippers will pay for transport services through our M-Pesa escrow system, Kamuzigo-Lipa. The payment will be held in escrow until the Shipper confirms that the goods have been delivered. Kamuzigo will then release the payment to the Driver. Shippers are charged a Kamuzigo Protection Fee (KPF) at the time of booking, which is a non-refundable fee for the use of the platform's security and escrow features.

5. Prohibited Activities

You may not use the Services for any illegal or unauthorized purpose. You agree to comply with all laws, rules, and regulations applicable to your use of the Services and your role as a Shipper or Driver. This includes, but is not limited to, laws regarding the transport of hazardous materials, illegal goods, and customs and excise.

6. Disclaimers

The Services are provided "as is" and "as available" without any warranties of any kind, either express or implied. Kamuzigo does not warrant that the Services will be uninterrupted or error-free. We make no warranty regarding the quality, accuracy, timeliness, truthfulness, completeness, or reliability of any content.

7. Limitation of Liability

To the maximum extent permitted by applicable law, Kamuzigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the services; (b) any conduct or content of any third party on the services; or (c) unauthorized access, use, or alteration of your transmissions or content.

8. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not to a breach of the Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
